The Employees' State Insurance Corporation covers over 14 crore insured persons across India. Any establishment with 10 or more employees (20 in some states) where any employee earns up to Rs. 21,000 per month is mandatorily covered. ESI provides insured employees with comprehensive medical treatment, cash benefits during sickness, and maternity benefits — making it one of the most important statutory benefits for working-class employees.

For employers, ESIC compliance requires monthly contribution deposits, half-yearly returns, new employee IP registration, and claim facilitation. Mistakes attract branch office scrutiny and recovery proceedings.

Common ESIC Compliance Mistakes

Including Employees Above Wage Ceiling

Employees who earn above Rs. 21,000 are not covered. Including them in ESI computation and deducting ESI from their salary is incorrect — this has happened at many establishments where salary structures changed mid-year.

Missing Newly Covered Employees

When an employee's salary is below Rs. 21,000 on joining, they must be registered as an IP immediately. Many HR teams delay this until the next return period.

Omitting Wages Components

ESI is on gross wages including overtime, incentive, production bonus, and night allowance. Many employers incorrectly exclude these components.

Half-Yearly Return Errors

Form 5 (half-yearly return) must capture all wages and contributions for the six-month period. Mismatches between monthly challans and the half-yearly return attract ESIC scrutiny.
